23. The Affembly had tranfmitted to them by the Committee of Bills, a petition from Mr Laurence Butter, minifter of Lethendie, accufed before the Prefbytery of Dunkeld, and Synod of Perth and Stirling, by Margaret Macfarlane. Mr Butter being heard for himself, and. Mr Hagart as his counsel; and Mr Inverarity at Caputh, and Mr Niven at Dunkeld, for the Prefbytery of Dunkeld; and for the Synod of Perth and Stirling, Mr Sommerville at Stirling, and Mr Inverarity; the Affembly, after reasoning, in refpect it was judicioufly ftated by the Prefbytery, that the libel with which they propofed to. ferve Mr Butter did not proceed upon a fama clamofa, Reverfed the Tentences of the Prefbytery and Synod appealed from; and remitted the cause to the Prefbytery, to proceed in the accufation of Mr Butter, if they fhall fee caufe, according to the rules of the Church. 24. An Addrefs to his Majefty, on the Marriage of the Princefs Royal of Great Britain, with his Serene Highnefs the Prince of Wirtemberg, was unanimoufly agreed to by the Affembly. Chapels of Eafe. The General Affembly had tranfmitted to them a petition from Mr Wm. Milli. gan, minifter at Kirkden. The Aff-mbly approved of the conduct of the Prefby tery of Arbroath, in laying before the Affembly their procedure refpecting the eftablishment of a Chapel of Eafe in the town of Arbroath, in conformity to the order of the laft Affembly. And the regulations being read, and having heard a member of the Prefbytery of Arbroath in explanation thereof, the Affembly were fatisfied of the neceffity and expediency of the Chapel intended, and having made fome alteration in the regulations, authorised and inftructed the Prefbytery of Arbroath to grant the defire of the petition, by erecting the Chapel of Eafe in queftion. 25. In purfuance of the refolution of the Affembly, they refolved themselves into a Committee of the whole Houfe, to confider the returns refpecting the Erection of Chapels of Eafe. They proceeded to confider the returns which were laid before them. The Committee finding that a fufficient number of returns had not been forwarded, for enabling the Affembly to enact the regulations into a law, a motion was made, that the Committee are of opinion, that the Affembly fhould Remit the faid regula tions and overture, and Re-tranfmit the fame. After a long debate, the Commit-' tee agreed to the following ftate of a vote, Re-tranfmit or Not; it being underftoad, that if it carry Re-tranfmit, the Committee are of opinion, that the AFfembly fhould re-enact the faid regula tions and overture, and re-transmit and enjoin fuch Prefbyteries as have fent no returns, to fend up their opinion to next Affembly, and if it carry Not, that, then the Committee are of opinion that the Affembly ought to Difmifs the overture. On the arrival of the fhip, the Sovereign, at Sidney-cove, he ftaid on board the veffel during all the time the continued in the cove. When, at length, the departure of the veffel made it neceffary for him to quit the fhip, he bought a fmall house and a garden, at a diftance from the town of Sidney, to which he retired with a fixed and deep decline, which brought him to his grave in lefs than two months. He received the moft liberal attention from Gov. Hunter; and his body, at his own defire, expreffed two days before his death, was buried in his own garden. 19. At the fame place, of a dyfentary, Mr Skirving. He had bought a fmall farm, already cleared, and fet himself to the improvement of it with indefatigable induftry. In getting in his harveft, he caught this complaint, which is very common in that country, and fell a vic tim to it. Great complaints were made of the captain of the veffel who carried over Skirving and his friends Muir and Palmer, who reprobated Margarot from their fociety, as having "polluted the holy and immortal caufe of liberty, by the affociation of his name with thofe of its pureft defenders;" and, notwithstanding his fuppofed treacherous affociation with Campbell, he was not brought to trial, but contiguous houfes were affigned to him and Muir; and they had no caufe to complain of any want of civility or attention while their perfons and fervices were adjudged to the Government, to cultivate the land till the expiration of their fentence. Gordon, who, for a period of upwards of 60 years, had creditably discharged the duties of his office. 19. In his 58th year, Philip Hayes, profeffor of mufick in the univerfity of Oxford, Muf. D. 1777. He had juft come to town, in order to prefide at the enfuing feftival for the new Mufical Fund. He dreffed himself in the morning, to attend the Chapel-royal, St James's; but fuddenly fhewed fymptoms. of approaching diffolution, and expired in a fhort time afterwards. He was fuppofed to be the largest man in England, and nearly equal in weight to the late celebrated Mr Bright, the miller of Malden, Effex. His remains were, on the 21ft, interred in St Paul's cathedral. The corpfe, on entering the church, was met by the gentlemen of the choirs of the Chapel-royal, St Paul's, and Weftminfter-abbey, who fang Dr Green's funeral anthem," Lord, let me know my end." &c. At his houfe in Stanhope-street, Charles Fitzroy, Lord Southampton, fon of Charles fecond Duke of Grafton, and fecond brother to the prefent Duke. He was born in 1737; and, in 1758, mar ried Anne, daughter and coheirefs of Sir Peter Warren, K. B. and vice admiral of the Red; by whom he had iffue, now living, nine fons and five daughters; his eldeft daughter died 1795, and three fons and a daughter died infants. His Lordfhip was a lieutenant-general, colonel of the third, or King's own regiment of dragoons, and groom of the ftole to the Prince of Wales; and was created Lord Southampton, Baron Southampton of Southampton in the county of Hants, Oct. 17, 1780. His chief refidence was at Fitzroy-farm, near Highgate, as lord of the manor of Totenhall, in Pancras parish, rebuilt within these few years, and the grounds laid out with much tafte, and the furrounding fcenery extremely picturefque. The farm, which he held in his own hands, confifted of about Ico acres. He is fucceeded in his titles and eftates by George's Ferdinand, his eldeft the office of British Conful, with honour to themfelyes, for nearly 60 years. 29. On his paffage from Porto Ferajo, to Britain, Lieut. James Hay Cochrane, of the fecond battalion of the Royals, eldeft fon to Capt. Cochrane of the Invalids. At Horham, Suffex, aged 66, Triftram Revell, Elq. of Carnfield-houfe, county of Derby. He was a magiftrate for the county of Derby, and lieut-col. of the Derbyshire militia; in which capacity, and in the rank of major, he had ferved fince 1773, when the militia for that county was raised. Lately, at Lisbon, Mrs Forbes, the Lady of General Forbes, in the Potuguese fervice. Literally of a broken heart, a young man named Buxton, late an Enfign in the 78th regiment. He was found dead in a waggon, in which he had taken his paffage from Bigglefwade for Doncafler, to join a regiment in which, from a combination of misfortunes, he had been compelled to enlift as a private. His remains were interred near Refing. ton-bridge, with military honours, the volunteers of the neighbourhood attending them to the grave. 22. At Bergen, John Wallace, Efq. British Contul for the north parts of Norway; he and his father had filled -, at Laufanne, in Swifferland, Tiffot, the celebrated phyfician. at Meffingham, in Lincolnshire, Winitred Foxon, aged 104 years. At Little Pinkerton, near Dunbar, Mifs Marianne Lee. -. - At Edinburgh, Mr William Nicol, late one of the Mafters of the High School of Edinburgh, diftinguished for his profound fkill in the Latin tongue, which he could both write and speak with the utmoft correctness and fluency. He poffe ffed the moft brilliant talents as a public teacher; and in private was eminently fuccefsful in communicating inftruction to gentlemen who had loft the opportunity of acquiring the Latin in their early youth. Attached to his friends with the most ardent affection, he was indefatigable in promoting their intereft; and his numerous acts of beneficence will be long remembered by the objects of them, after his failings fhall have been buried in his early grave. He obtained the above mentioned refpectable office by comparative trial in the year 1774, and refigned it about two years ago.
