period which shall not exceed the 31st December, 1860.

4. For yarns and manufactures in flax and hemp, from the 1st June, 1861.

5. And for all other articles from the 1st October, 1861.

XVI. His Majesty the Emperor of the French engages that the ad valorem duties payable on the importation into France of merchandize of British production and manufacture, shall not exceed a maximum of 25 per cent. from the 1st of October, 1864.

XVII. It is understood between the two High Contracting Powers, as an element of the conversion of the ad valorem duties into specific duties, that for the kinds of bar iron which are at present subjected on importation into France to a duty of 10 francs, not including the 2 additional decimes, the duty shall be 7 francs on every 100 kilogrammes until the 1st of October, 1864, and 6 francs from that period, including in both cases the 2 additional decimes.

XVIII. The arrangements of the present Treaty of Commerce are applicable to Algeria, both or the exportation of her prouce and for the importation of British goods.

XIX. Each of the two High Contracting Powers engages to confer on the other any favour, privilege, or reduction in the tariff of duties of importation on the articles mentioned in the present Treaty, which the said Power may concede to any third Power. They further engage not

XVII. Il demeure entendu entre les deux Hautes Puissances Contractantes, comme élément de la conversion des droits ad valorem en droits spécifiques, que pour les fers actuellement grevés à l'importation en France d'un droit. de 10 francs non compris le double décime additionnel, le droit sera de 7 francs pour 100 kilogrammes jusqu'au ler Octobre, 1864, et de 6 francs à partir de cette époque, les 2 décimes additionnels compris dans les deux cas.

XVIII. Les dispositions du présent Traité de Commerce sont applicables à l'Algérie, tant pour l'exportation de ses produits que pour l'importation des marchandises Britanniques.

XIX. Chacune des deux Hautes Puissances Contractantes s'engage à faire profiter l'autre Puissance de toute faveur, de tout privilége ou abaissement dans les tarifs des droits à l'importation des articles mentionnés dans le présent Traité, que l'une d'elles pourrait accorder à une tierce

XX. The present Treaty shall not be valid unless Her Britannic

Majesty shall be authorized by the assent of her Parliament to execute the engagements contracted by her in the Articles of the present Treaty.

XXI. The present Treaty shall remain in force for the space of 10 years, to date from the day of the exchange of ratifications; and in case neither of the High Contracting Powers shall have notified to the other, 12 months before the expiration of the said period of 10 years, the intention to put an end to its operation, the Treaty shall continue in force for another year, and so on from year to year, until the expiration of a year, counting from the day on which one or other of the High Contracting Powers shall have announced its intention to put an end to it.

The High Contracting Powers reserve to themselves the right to introduce by common consent into this Treaty, any modification which is not opposed to its spirit and principles, and the utility of which shall have been shown by experience.

XXII. The present Treaty shall be ratified, and the ratifications shall be exchanged at Paris within the period of 15 days, or sooner if possible.

In faith whereof, the respective

XXI. Le présent Traité restera en vigueur pendant 10 années à partir du jour de l'échange de ses ratifications; et dans le cas où aucune des deux Hautes Puissances Contractantes n'aurait notifié, 12 mois avant l'expiration de la période de 10 années, son intention d'en faire cesser les effets, le Traité continuera à rester en vigueur encore une année, et ainsi de suite, d'année en année, jusqu'à l'expiration d'une année à partir du jour où l'une ou l'autre des Hautes Puissances Contractantes l'aura dénoncé.

Les Hautes Puissances Contractantes se réservent la faculté d'introduire, d'un commun accord, dans ce Traité, toutes modifications qui ne seraient pas en opposition avec son esprit ou ses principes, et dont l'utilité serait démontrée par l'expérience.

XXII. Le présent Traité sera ratifié, et les ratifications en seront échangées à Paris dans le délai de 15 jours, ou plus tôt si faire se peut.

En foi de quoi, les Plénipoten

to countervail the charges with which, in consequence of the operation of the laws of Customs and Excise, home-made British spirits have now to contend; and that a surtax limited to the rate of 2d. a gallon would still leave home-made British spirits subject to a differential duty in favour of foreign brandies and spirits.

Consequently the Government of Her Britannic Majesty having represented these circumstances to the Government of His Majesty the Emperor of the French, and His Imperial Majesty having consented that the amount of the said surtax shall be increased, the two High Contracting Parties to the said Treaty of Commerce do, by the present Additional Article, agree that the amount of such surtax shall be 5d. a gallon; and Her Britannic Majesty engages to recommend to Parliament the admission into the United Kingdom of brandies and spirits imported from France at a duty exactly equal to the excise-duty levied upon homemade spirits, with the addition of a surtax of 5d. a gallon.

The present Additional Article shall have the same force and validity as if it had been inserted in the Treaty of Commerce of the 23rd of January last.

It shall be ratified, and the ratifications thereof shall be exchanged at Paris within 5 days from the date of its signature.

In witness whereof, the respective Plenipotentiaries have signed

En conséquence le Gouvernement de Sa Majesté Britannique ayant fait connaître ces circonstances au Gouvernement de Sa Majesté l'Empereur des Français, et Sa Majesté Impériale ayant consenti à ce que le montant de la dite surtaxe fut augmenté, les deux Hautes Parties Contractantes au dit Traité de Commerce sont convenues par le présent Article Additionnel, que le montant de cette surtaxe serait de 5d. par gallon; et Sa Majesté Britannique s'engage à recommander au Parlement l'admission dans le Royaume Uni des eaux-de-vie et esprits importés de France, à un droit exactement égal au droit d'accise perçu sur les esprits de fabrication indigène, avec addition d'une surtaxe de 5d. par gallon.

Le présent Article Additionnel aura la même force et valeur que s'il avait été inséré dans le Traité de Commerce du 23 Janvier dernier.

Il sera ratifié, et les ratifications en seront échangées à Paris, dans le délai de 5 jours à partir de la date de sa signature.

Ir having been found impossible to conclude the negotiation of the arrangement which is to fix, according to paragraph 1 of Article XIII of the Treaty of Commerce concluded between Great Britain and France, the 23rd of January last, the rate of the specific duties to be levied on British merchandize imported into France, within the period stipulated by the said Article, the High Contracting Parties have considered it advisable, in the interest of the respective commerce of the two countries, to make a fresh arrangement with a view to insure the gradual execution of the aforesaid Treaty within the periods fixed by the

same.
